The Briarwood Beach Land Trust was established in 1998 to acquire and preserve the property known as Briarwood Beach (Map 53, Lot 1001).

Original Grantor Address List
This document lists the street addresses of the original grantors who established the Briarwood Beach Land Trust in 1998. An “X” next to an address indicates that the homeowner at that time signed a commitment letter to become a beneficiary of the Trust.

If the property has changed hands since the Trust was created, the beneficial interest must have been formally transferred by deed, in accordance with Section 7 of the Trust. This deed must include both the transfer of the property and the transfer of beneficial interest, along with a signed acknowledgment of the Trust terms (see Exhibit A of the Trust document). Alternatively, the beneficial interest may have been transferred or assigned by vote of the beneficiaries or the Trustee, with a new commitment letter signed by the current owner.
Historically, the Trustees have not required new owners to sign an acknowledgment or submit updated documentation upon transfer of ownership. As a result, there may be properties whose current owners assume they are beneficiaries, but where no formal transfer of beneficial interest has been recorded.
Our goal over the next year is to fully update the Schedule of Beneficiaries and collect signed documents for any past property sales or transfers that may be needed. To be a beneficiary, you must own a property that was part of the original grantor list (see the Grantor List above), and the beneficial interest must have been conveyed to you by deed at the time of purchase.
If that transfer wasn’t included in the deed, the Trust grants the Trustees the authority to complete the transfer on your behalf. Section 7 of the Trust includes a Power of Attorney provision that allows the Trustees to assign the beneficial interest to the new owner when a formal transfer was not executed.

According to the Deed and the Trust document, the Briarwood Beach Land Trust was established in 1998 to acquire and maintain a single parcel—commonly referred to as Briarwood Beach—located in Wareham, Massachusetts. The specific property is recorded as Map 53, Lot 1001, as corrected in the 1999 amendment to the Trust document https://www.wareham.gov/DocumentCenter/View/348/Map-53-PDF
That parcel is held in Trust exclusively for the benefit of the property owners listed in the Schedule of Beneficiaries. No other land or assets are held by the Trust.
When the Briarwood Beach Land Trust was established in 1998, each original grantor contributed $505 to help acquire the beach property (Map 53, Lot 1001), form the Trust, and cover ongoing costs such as insurance and property taxes.
That original funding carried the Trust through approximately 2014.
Since 2014, property taxes have been paid through voluntary donations from individual beneficiaries. These quarterly payments ensure that the property remains in good standing with the Town of Wareham.
